These Terms of Use (“Terms”) govern your use of the Deskies macOS application, related services, and website (together, “Deskies”). By creating an account or using Deskies, you agree to these Terms.
The service
Deskies is a presence and messaging app for friends on macOS. Features may change as we improve the product. We may offer early access, invite-gated access, or paid access packs.
Eligibility
You must be at least 13 years old (or the minimum age required in your country) and able to form a binding contract. You are responsible for the Google account you use to sign in and for keeping your device secure.
Accounts
You agree to provide accurate profile information and not to impersonate others. We may suspend or terminate accounts that abuse the service, harass others, attempt to break security, or violate these Terms.
Access packs & invites
Access may require a one-time purchase (currently a pack that unlocks a limited number of seats) or an invite code from another user. Purchases are processed by our payment provider. Unless required by law, access packs are non-refundable once delivered. Invite codes are personal; do not sell or publicly scrape them. We may invalidate codes or access obtained through abuse.
Acceptable use
You agree not to:
- Use Deskies for unlawful, harmful, or harassing activity
- Upload malware or content you do not have the right to share
- Probe, overload, or disrupt our servers or other users
- Reverse engineer the app except where local law allows
- Resell Deskies access or automated access to the service without our permission
Your content
You retain ownership of messages, profile content, and attachments you submit. You grant us a limited license to host, transmit, and display that content solely to operate Deskies (including delivering it to people you chat with). You are responsible for what you share.
Screen capture
Optional Screen Recording permission is used only for user-initiated region screenshots. Misuse of capture features (for example capturing others’ private information without permission) is your responsibility and may result in account action.
Third-party services
Sign-in uses Google. Payments use Dodo Payments. Their terms and privacy policies also apply to those interactions. Deskies is not affiliated with Apple Inc.; “Mac” and “macOS” are trademarks of Apple Inc.
Intellectual property
Deskies, including its design, branding, and software, is owned by us or our licensors. These Terms do not transfer ownership to you. You may use the app as provided for personal, non-commercial use unless we agree otherwise in writing.
Disclaimer
Deskies is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. Presence and messaging may be delayed or unavailable.
Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total liability for any claim relating to Deskies is limited to the greater of (a) the amount you paid us for Deskies in the 12 months before the claim or (b) USD $50.
Indemnity
You agree to indemnify and hold us harmless from claims arising out of your content, your use of Deskies, or your violation of these Terms, to the extent permitted by law.
Termination
You may stop using Deskies at any time. We may suspend or end access if you violate these Terms or if we discontinue the service. Provisions that by nature should survive (including ownership, disclaimers, and liability limits) will survive termination.
Changes
We may update these Terms by posting a new version on this page. Continued use after changes become effective constitutes acceptance, except where local law requires otherwise.
Governing law
These Terms are governed by the laws of India, without regard to conflict-of-law rules, unless mandatory consumer protections in your country say otherwise. Courts in India will have exclusive jurisdiction, subject to those protections.
